PRIVATE LANDLORD REGISTRATION

As from 30 April 2006 all private landlords in Scotland are required to be registered with their local authority to ensure they are “fit and proper” to let residential property. It is the owner of the property who must register.

Existing Landlords Need to either be registered or at least have an application to register lodged with their local authority.
Intending Landlords Must be registered prior to letting commences.

IT WILL BE AN OFFENCE TO LET A HOUSE IF NOT REGISTERED.

“The requirement will help local authorities to remove disreputable landlords from the market and protect tenants and their neighbours from the impact of antisocial behaviour and mismanaged property on the wider community.” [Better Renting Scotland]

Various exemptions apply and you should check your local authority. Examples are:

(i) Letting out part of your home.
(ii) A house let to the tenant of agricultural holdings or croft.
(iii) Used for holiday lets only.

House in Multiple Occupancy (HMO) licence
If you hold an HMO licence then you will be registered automatically as you are already classed as a “fit and proper” person. There is no requirement to pay for registration although any property held outwith your HMO licence will need to be registered.

Member of Accreditation Schemes
You will need to check with your local authority on an individual basis.

You are a registered Agent.
You are not required by law to be registered but are encouraged to do so. Again there is no requirement to pay for registration for properties managed.

How to register

Registration can be made either online at www.landlordregistrationscotland.gov.uk or you can obtain a registration form from each local authority.

You need to register with every local authority in whose area your letting properties are situated and discount is available for this on line.

Cost

Initial cost is £55.00 for each local authority registration required. Discounts may be available.

For each property the landlord owns an extra £11 will also be payable.

Registration is valid for three years.
